FCC Reinstates Net Neutrality Rules: New Regulations to Protect Consumer Data and Encourage Equitable Broadband Access

The Federal Communications Commission (FCC) has reinstated net neutrality rules that were previously revoked in 2017 under the administration of former President Donald Trump. These new regulations create potential conflict with broadband service providers who must now adhere to more stringent legislation.

The Spectrum and National Security Act of 2024, which was passed by Congress, includes these new net neutrality rules. The FCC has redefined broadband as a telecommunications service, giving it more regulatory power over internet providers. Under this act, providers are no longer allowed to block or slow down broadband traffic or create paid preferential lanes for specific websites or services. This reflects similar rules that were put in place during Barack Obama’s presidency in 2015.

One of the main goals of these regulations is to protect consumer data, particularly sensitive information like location data, which providers can no longer sell. The FCC wants to exercise its authority over broadband in a targeted manner to encourage continued investment and innovation in the sector while also overriding conflicting state or local policies.

FCC Chairwoman Jessica Rosenworcel, a member of the Democratic Party appointed by Biden, emphasized the importance of accessible and equitable broadband access for all Americans. She highlighted how previous rollbacks of net neutrality had led to discrimination against certain websites and services, particularly those that could not afford to pay for preferential treatment. Despite some opposition from FCC members and industry associations who fear that reinstating net neutrality will hinder growth and innovation, Rosenworcel believes that these regulations are necessary to ensure a fair and open internet for all consumers.
