In response to Congressman Ami Bera’s inquiry about the current state of artificial intelligence (AI) in healthcare, the American Hospital Association (AHA) emphasized the need for flexible regulation that can keep up with innovation. The organization highlighted that AI is not a one-size-fits-all technology and its regulation should be tailored to its specific use and application in healthcare settings.
According to AHA, sector-specific approaches to regulation have been successful in allowing oversight organizations to address the unique risks associated with different technologies. However, the organization cautioned against applying a blanket approach to AI regulation as it could hinder innovation in patient care and hospital operations. Instead, AHA urged Congress to consider regulating AI based on its use across different sectors, similar to how software is regulated.
In addition, AHA proposed adapting existing technology-focused regulatory frameworks to accommodate the unique aspects of AI. By aligning AI regulation with existing frameworks and considering its specific uses in healthcare, AHA believes that patient safety and privacy can be better protected while promoting innovation.
