Uber appeals reclassification of couriers as salaried workers

Uber has announced that it will be appealing a decision made by the Commission for the Regulation of the Employment Relationship (CAR) which requires three Uber Eats delivery drivers to be reclassified as salaried employees. The company stated that it regrets the decision and believes it only applies to the three individuals in question.

In December 2023, three couriers from Uber Eats questioned whether the platform’s requirement for them to register as self-employed individuals was in line with the law. They also argued that their work should have been classified as that of an employee. The committee ruled in favor of the delivery drivers, stating that their freedom was limited and ordered for them to be reclassified as salaried workers.

Uber expressed regret over the decision, noting that it only applies to the three individuals in question. The company highlighted that thousands of independent couriers choose their app for the flexibility it offers in deciding when, where, and how much they want to work. A spokesperson stated that they will be appealing the decision.

The company is committed to providing its couriers with a range of benefits including health insurance, paid time off and retirement plans but also believes in maintaining flexibility for its workers who value it highly. The appeal is expected to go through a labor court hearing which will make a ruling on the case.
